In this case the Executive Council (the Acting Colonial Secretary and the Colonial Treasurer dissenting) refused to hand over the accused Chan Tik-cheung alias Chan Sau to the Chinese Government.
The reason why the Council refused was, that the evidence which had been received by the Magistrate when taken as a whole was so unsatisfactory that they were not even of opinion that a prima facie case had been made out against the accused.
